Guidance for FMLA/ADA Issues

MWorks has occupational health nurses and board certified occupational medicine physicians who understand the Family Medical Leave Act (FMLA) and Americans with Disabilities Act (ADA ) and can advise you on how to handle your most difficult cases. Companies who use MWorks’ FMLA/ADA consulting services save a lot of time and money by minimizing FMLA abuse and avoiding litigation.

FMLA is particularly challenging for many human resource managers because they aren’t familiar with medical terminology, many physicians do not fill out the forms completely (incredibly, 99% of the FMLA certification forms that we review do not have enough information to make a determination!), and the law prohibits employers from talking directly to an employee’s physician for clarification.

MWorks nurses can help by following up with an employee’s physician (with the employee’s permission) to clarify information on the form and have the physician fill in any missing information. This service is efficient, working primarily by fax, phone, and email. MWorks nurses can help on a case by case basis, or provide a comprehensive review of all FMLA requests.

A review of an individual case includes:

  • Investigate an FMLA request
  • Review documentation and make a written recommendation to the employer regarding whether the FMLA criteria have been met
  • Clarify information with the medical provider and/or employee
  • Schedule and coordinate second and third opinions as needed
  • Consult with your staff regarding problematic or complex FMLA issues

A comprehensive review of your FMLA administration includes:

  • Participation with you to review established procedures
  • Identify ways to make processes more efficient
  • Review, edit, and/or establish operational policies, practices, forms, etc.
  • Provide training.

Second or third opinions:

When a second or third opinion is called for, MWorks board certified occupational medicine physicians are uniquely qualified to provide second or third opinions on FMLA requests.
